Pursuant to that EM Research Organization Inc, (the “Company”), licensed by Professor Teruo Higa, the researcher and owner of EM product, to monitor, market and sub-license the EM Know-how and trademark to any person all over the world, has filed a lawsuit against EM Kyusei to request the Court to order EM Kyusei to cease manufacturing and distributing EM products and trademark as previously licensed by the Company due to EM Kyusei breached the agreement entered into with the Company and that the Intellectual Property and International Trade Court concluded on 28th July 2010 to dismiss the complaint of the Company; in whcih EM Kyusie cited in EM Kyusie’s letter no EM53/020 dated 29th July 2010 regarding the notification of the judgment result of the case initiated by EMRO that the dismissal of the EMRO’s complaint by the Court results in EM Kyusie remains to be the exclusive licensee in Thailand to manufacture and distribute EM product, in addition if there is any EM product manufactured and distributed by any third person copying the products of EM Kyusie, EM Kyusie will prosecute a civil and criminal charges against such person.
The Company wishes to clarify the fact to all EM distributors and end-users in Thailand as follows:
1. The Company has filed an appeal application to the Court to appeal the judgment of the Intellectual Property and International Trade Court and the Court has ordered to accept the appeal application of the Company. The case is now under consideration of the Supreme Court. The case does not become final until the judgment of the Supreme Court is made.
2. EM Kyusei is not an exclusive licensee in Thailand to manufacture and distribute EM product due to that the agreement by which the Company used to license EM Kyusie does not grant any exclusive rights to EM Kyusei. The statement claimed by EM Kyusie that it is the exclusive licensee of EM product is not true and correct.
3. Presently, the Company has granted a license to EMRO Asia to manufacture and distribute EM products as well as to use EM trademark and packaging designed by the Company as previously licensed to EM Kyusei. The Company therefore wishes to confirm to all EM distributors and end-users in Thailand that EM product manufactured by EMRO Asia is a legitimate product licensed by the Company which are not by any mean copied the product of EM Kyusei.
4. Apart from the above, the Company also dispatches the Japanese EM experts to transfer the technology and control the production of EM product of EMRO Asia directly. At present, Em Kyusei has no EM experts of EMRO to inspect the quality of EM products in EM Kyusie anymore. The Company therefore wishes to inform and comfort all EM distributors and end-users in Thailand that EM product of EMRO Asia are manufactured under the stringent control of the Company in all processes according to the formula discovered by Professor Teruo Higa which is continuously developed by the Company in order to allow all EM distributors and end-users in Thailand to have a chance to consume EM product manufactured under the highest standards like in Japan, USA and Europe.
